Please read these Terms of Service carefully before using Talking Pet AI: Short Video. By using the App, you agree to be bound by these terms.

1. Acceptance of Terms. Talking Pet AI: Short Video ("the App") is published by AI-APP-DEV LLC ("we," "us," or "our"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service. The App allows you to create AI-generated short videos of your pets by uploading photos, audio recordings, and text. The App uses artificial intelligence technology to generate talking pet videos based on your inputs.

3. Account Registration. You may use the App without creating an account, but account registration is required to sync your credits and purchase history across different devices and platforms (Android and iOS). When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account

4. In-App Purchases and Credits.

  • The App offers in-app purchases of credits that can be used to generate videos.
  • Credits are consumed when you generate videos using the App.
  • Credits do not expire and remain in your account until used.
  • Credits purchased without an account are stored locally on your device and will not sync across devices or platforms.
  • Credits purchased with an account are linked to your account and will sync across devices where you sign in.

:::note NON-REFUNDABLE POLICY All credit purchases are final and non-refundable. Once you purchase credits through the App, the transaction is complete and credits cannot be refunded, returned, or exchanged for cash or other forms of payment. This policy applies regardless of whether you use the credits or not. By making a purchase, you acknowledge and agree that all sales are final. :::

5. Use of the App. You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App to create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Upload content that infringes on the intellectual property rights of others
  • Upload content that contains viruses, malware, or other harmful code
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Use automated systems or bots to access or use the App
  • Share your account credentials with others

6. User Content. You retain ownership of any photos, audio, text, or other content you upload to the App. By uploading content, you grant us a license to use, process, and store your content solely for the purpose of providing the App's services. All user-uploaded files are automatically deleted from our storage after seven (7) days.

7. Intellectual Property. The App, including its design, features, functionality, and content (excluding user-uploaded content), is owned by AI-APP-DEV LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

8. Disclaimer of Warranties. The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components. We do not guarantee the accuracy, quality, or suitability of any generated content.

9. Limitation of Liability. To the maximum extent permitted by law, AI-APP-DEV LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

10. Termination. We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, for any reason, including if you violate these Terms. Upon termination, your right to use the App will immediately cease.

11. Changes to Terms. We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

12. Governing Law. These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

General Terms of Service​

GENERAL

1. Acceptance of Terms. These General Terms of Service ("Terms") govern your use of AI-APP-DEV LLC products and services ("Services"), unless a specific product section states otherwise. By accessing or using any of our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Account Registration. Certain features of our Services may require you to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3. Payment Terms.

  • Pricing: Prices for our Services are displayed at the time of purchase. We reserve the right to modify prices at any time.
  • Payment: Payments are processed through third-party payment providers (Apple App Store, Google Play Store, RevenueCat). All payment transactions are subject to the terms of service of these providers.
  • Refunds: Unless explicitly stated otherwise for a specific product, all purchases are final and non-refundable. Please refer to product-specific terms for any exceptions.
  • Subscriptions: Subscription services automatically renew unless cancelled at least 24 hours before the end of the current period. You may manage or cancel subscriptions through your device account settings.

4. Acceptable Use Policy. You agree to use our Services only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Services to create or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
  • Upload or transmit content that infringes on the intellectual property rights of others
  • Interfere with or disrupt the Services or servers connected to the Services
  • Attempt to gain unauthorized access to any portion of the Services
  • Use automated systems or bots to access or use the Services without express permission
  • Share your account credentials with others or use accounts belonging to others
  • Reverse engineer, decompile, or disassemble any aspect of the Services

5. User Content.

  • Ownership: You retain ownership of any content you submit to our Services ("User Content").
  • License: By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, store, and transmit your User Content solely for the purpose of providing the Services.
  • Responsibility: You are solely responsible for your User Content and any consequences of its submission.
  • Deletion: Unless otherwise specified for a particular product, User Content is retained only as necessary to provide the Services and may be deleted after a specified period.

6. Intellectual Property.

  • The Services, including all features, functionality, design, and content (excluding User Content), are owned by AI-APP-DEV LLC and protected by copyright, trademark, and other intellectual property laws.
  • You may not copy, modify, distribute, or create derivative works based on the Services without our express written permission.
  • All trademarks, service marks, and trade names used in the Services are the property of their respective owners.

7. Disclaimer of Warranties. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT OF THIRD-PARTY RIGHTS
  • ACCURACY, RELIABILITY, AVAILABILITY, TIMELINESS, OR PERFORMANCE OF THE SERVICES
  • THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE
  • THAT VIRUSES OR OTHER HARMFUL COMPONENTS WILL BE PRESENT OR ABSENT

8. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI-APP-DEV LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Termination.

  • We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice.
  • Upon termination, your right to use the Services will immediately cease.
  • We reserve the right to delete or disable your account and all related data and files at any time.
  • All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

10. Changes to Terms. We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Services after such changes constitutes your acceptance of the new Terms. For specific products, material changes may also be communicated via in-app notifications or email.

11. Governing Law and Dispute Resolution.

  • These Terms shall be governed by and construed in accordance with the laws of the United States.
  • Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
  • YOU AND AI-APP-DEV LLC AGREE THAT ANY DISPUTE SHALL BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS ACTION.

12. Indemnification. You agree to indemnify, defend, and hold harmless AI-APP-DEV LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services or your violation of these Terms.

13. Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.

14. Entire Agreement. These Terms, together with any product-specific terms and our Privacy Policy, constitute the entire agreement between you and AI-APP-DEV LLC regarding your use of the Services.
